These Terms & Conditions (the "Agreement") govern your use of the NEETbricks App and the web app available at https://neetbricks.com/ (collectively, the "Platform"). Please read this Agreement carefully before accessing or using the Platform. By accessing or using the Platform, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the Platform.

1. Introduction and Definitions

In keeping with best practices for mobile applications, this Agreement introduces NEETbricks App, defines key terms, and identifies the parties to these Terms:

• "NEETbricks," "we," "us," and "our" refer to NEETbricks App.
• "User," "you," or "your" means any individual who accesses or uses the Platform.
• "Services" refers to the educational content, live classes, quizzes, practice tests, messaging, and other features provided through the Platform.

By using the Platform, you represent that you are at least 18 years old or have consent from a parent or guardian. If you are a minor under applicable law, your parent or guardian must review and accept this Agreement on your behalf.

2. License to Use

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable licence to access and use the Platform and its content solely for your personal, non-commercial educational use. This licence does not include any right to:

• Copy, modify, distribute, sell, or lease any part of the Platform or its content.
• Attempt to reverse engineer or extract the source code of the software.
• Use any data-mining or similar data-gathering tools.
• Circumvent any technical measures we use to protect the Platform.

We reserve all rights not expressly granted to you.

3. Acceptable Use and Prohibited Conduct

Your use of the Platform must comply with the intended educational purpose. You agree not to:

• Violate any applicable laws or regulations.
• Share or transfer your account credentials.
• Post or transmit any content that is unlawful, harmful, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Infringe any intellectual property rights or privacy rights.
• Send spam, phishing messages, or unsolicited communications.
• Use the Platform to collect personal data about other users without their consent.
• Interfere with the operation of the Platform or attempt to access any systems or data without authorisation.

We may suspend or terminate your account if you breach these rules, as explained in Section 6.

4. Registration and Information

When you register for an account, we collect certain personal information such as your name, email address, phone number, date of birth, education details, and other data necessary to provide our services. We also collect information when you purchase a course, contact customer support, or participate in forums. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs through your account. If you suspect unauthorised use of your account, you must notify us immediately.

5. Cookies and Tracking Technologies

We use cookies and similar technologies to recognise your browser or device, personalise your experience, and analyse Platform usage. Cookies allow us to deliver content that is most relevant to users and to make login faster. You may disable cookies through your browser settings, but some features of the Platform may not function properly if cookies are disabled.

6. Account Termination and Suspension

We reserve the right to suspend or terminate your account at our sole discretion if you violate this Agreement or engage in conduct that we deem harmful to the Platform or its users. We may also remove or restrict access to any content you post. If you wish to delete your account, you may do so within the app's settings or by contacting us. Account termination does not limit any other rights or remedies we may have under the law.

7. Intellectual Property

All content, features, and functionality on the Platform—including text, graphics, logos, images, software, and course materials—are owned by NEETbricks or our licensors and are protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Platform without our prior written consent.

We respect intellectual property rights and expect our users to do the same. If you believe content on the Platform infringes your intellectual property rights, please contact us using the information in Section 16.

8. User-Generated Content

The Platform may allow you to post questions, answers, comments, photos, or other content ("User Content"). You retain ownership of your User Content, but by submitting it on the Platform you grant us a worldwide, royalty-free, non-exclusive licence to use, reproduce, modify, adapt, publish, translate, and distribute it in any media. This licence allows us to promote and improve the Services and make User Content available to other users.

You represent that you have all necessary rights to upload User Content and that doing so will not violate any third-party rights. We reserve the right (but are not obligated) to remove or modify any User Content that violates this Agreement or is otherwise objectionable.

9. Payments, Subscriptions, and Refunds

If you subscribe to paid courses or purchase any goods or services through the Platform, you agree to pay all applicable fees. Payment topics such as subscription fees, payment methods, cancellation, promotions, returns, and refunds are addressed in this section:

• Subscription fees: We offer various subscription plans and one-time purchase options. Fees are payable at the time of purchase. Access will be granted once payment is processed successfully.
• Payment methods: We accept major payment methods as displayed during checkout. You authorise us to charge your payment method for recurring subscription fees until you cancel.
• Cancellation policy: Subscriptions may be cancelled at any time, but no refunds will be provided for amounts already paid. If you inadvertently purchase the wrong course, you may request a switch to another plan of equal value within 10 days of purchase.
• Returns and replacements: For physical products such as books, we only offer replacements for items damaged in transit or delivered incorrectly. Returns are not accepted if the shipping address is incorrect or if the product is refused upon delivery.

10. Privacy Policy

Your privacy is important to us. We collect, use, and disclose personal information as described in our Privacy Policy. These Terms incorporate the Privacy Policy by reference.

11. Limitation of Liability

To the fullest extent permitted by law, NEETbricks and its directors, officers, employees, agents, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. This includes loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, our liability will be limited to the maximum extent permitted by law.

12. Disclaimers and Warranties

We provide the Platform and all content "as is" without warranty of any kind. While we strive to offer accurate and up-to-date information, we make no representations or warranties about the completeness, reliability, suitability, or availability of the Services. Your use of the Platform is at your own risk. We do not guarantee that the Services will be uninterrupted, secure, or error-free, or that any defects will be corrected. We also do not guarantee any specific outcomes from using our courses or content.

13. Governing Law and Dispute Resolution

This Agreement is governed by the laws of India. Any disputes arising out of or relating to this Agreement or the Platform will be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka. You agree to attempt to resolve any dispute with us informally by contacting our support team before pursuing other remedies. If a dispute cannot be resolved informally, it will be subject to binding arbitration in India under the Arbitration and Conciliation Act, 1996, conducted in English by a sole arbitrator appointed mutually by the parties.

14. Changes to This Agreement

We may modify these Terms & Conditions at any time. We will provide notice of material changes by posting an updated version on the Platform or by sending you a notification. Your continued use of the Platform after the effective date of the updated Terms constitutes your acceptance of the changes.

15. Entire Agreement and Severability

This Agreement, along with the Privacy Policy and any other policies we post, constitutes the entire agreement between you and NEETbricks regarding your use of the Platform. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
